What these terms cover

These Terms of Service govern your use of the BuiltFlow website and any services you engage BuiltFlow to provide. By booking a call, submitting an inquiry, or entering into a project agreement with BuiltFlow, you agree to these terms.

BuiltFlow is a custom web application development service operated by Elias Crespo Molato. References to "BuiltFlow," "we," "us," or "our" refer to this service.

Our services

BuiltFlow designs and builds custom web applications for coaches, course creators, and program operators. This includes but is not limited to student dashboards, program delivery systems, admin tools, and related web-based products.

Each project is governed by a separate project agreement or statement of work that defines the specific scope, deliverables, timeline, and payment terms. These Terms of Service apply in addition to any project agreement.

We reserve the right to decline any project inquiry at our discretion.

Project agreements and scope

Work begins only after a signed project agreement and receipt of any deposit outlined in that agreement. Verbal commitments, email conversations, or scoping calls do not constitute a binding agreement.

Any changes to the agreed scope during a project are subject to a change order process. Additions to scope may affect the timeline and cost and require written approval from both parties before work proceeds.

Scope creep is the most common source of project friction. If something was not in the original agreement, it is not included in the original price or timeline. We handle this transparently and without drama, but we do hold the line on it.

Payment terms

Payment terms for each project are defined in the project agreement. Standard terms include a deposit before work begins and milestone-based payments tied to delivery stages.

Invoices are due within the timeframe specified in the project agreement. Late payments may result in a pause in work until the account is brought current.

All payments are non-refundable once work for a given milestone has been completed and delivered, unless otherwise stated in writing in the project agreement.

BuiltFlow is not responsible for any fees charged by payment processors or banks.

Intellectual property and ownership

Upon receipt of full payment for a project, the client owns the final deliverables as specified in the project agreement. This includes all custom code, design assets, and content produced specifically for that project.

BuiltFlow retains the right to:

  • Reference the project in our portfolio and marketing materials, unless the client requests otherwise in writing
  • Reuse general patterns, techniques, and non-client-specific code components in future projects

Third-party tools, libraries, frameworks, and services used in a project remain subject to their own licenses. BuiltFlow is not responsible for changes to third-party services after delivery.

Any content, copy, brand assets, or materials provided by the client remain the property of the client.

Client responsibilities

Successful delivery depends on the client providing timely feedback, approvals, and any required materials. Specifically, you agree to:

  • Provide all necessary content, assets, and credentials within the timeframes agreed in the project agreement
  • Respond to requests for feedback or approval within a reasonable timeframe
  • Designate a single point of contact for the project to avoid conflicting direction

Delays caused by late content, missed feedback windows, or unresponsiveness may extend the project timeline. BuiltFlow is not responsible for timeline overruns caused by client delays.

Revisions and support

The number of revision rounds included in a project is defined in the project agreement. Revisions beyond the agreed scope are billed at the hourly or day rate specified in that agreement.

Post-launch support, maintenance, and updates are not included unless explicitly outlined in the project agreement as a separate engagement.

Cancellation and termination

Either party may terminate a project with written notice. In the event of termination:

  • The client is responsible for payment for all work completed up to the date of termination
  • Any deposit paid is non-refundable unless BuiltFlow has failed to begin work within the agreed timeframe
  • BuiltFlow will deliver all completed work to the client upon receipt of payment for work done

If a client becomes unresponsive for more than 30 days without prior notice, BuiltFlow reserves the right to close the project. Any deposits or payments made will not be refunded.

Limitation of liability

BuiltFlow delivers custom software. All work is provided in good faith and to the best of our ability. However, we do not guarantee specific business outcomes, revenue results, or performance metrics from any deliverable.

To the maximum extent permitted by law, BuiltFlow's total liability for any claim arising from our services is limited to the total amount paid by the client for the specific project in question.

BuiltFlow is not liable for any indirect, incidental, or consequential damages including lost revenue, lost data, or business interruption.

Governing law

These terms are governed by the laws of British Columbia, Canada. Any disputes arising from these terms or our services will be resolved in the courts of British Columbia, unless both parties agree in writing to an alternative dispute resolution process.

Changes to these terms

We may update these terms from time to time. The current version is always available at builtflow.com/terms. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms. For active project agreements, the terms in effect at the time of signing apply.
